A subdivision is the dividing of a piece of land to create two or more sections. Each section has its own certificate of title which describes the land and ownership and this is called a 'lot'. The rules for subdivisions are governed by the District Plan for your area, and determine how your property may be subdivided. Consent from your local council is required before going ahead with a subdivision.
What is involved?
Typically, a subdivision will take a minimum of 4 - 6 months for a simple project. Commonly, subdivisions take 9 - 12 months from the start of the process to the issue of the new titles. Owners may elect to use up to a maximum period of eight years from the date of the issue of the resource consent as provided for under the Resource Management Act. Councils generally require a deposit when an application is made and will then invoice you for any additional costs once their decision has been finalised. For complex applications, councils may invoice monthly. In granting your subdivision consent, most councils levy financial contributions for reserves, roading, storm water, wastewater, and water supply as is appropriate to your area. These costs vary from council to council.
